The Terms and Conditions of Sale set forth below apply to the purchase of products (the "Products") displayed on the website shop.cruna.com ("Site") of Cruna S.r.l. ("Cruna" or the "Seller"). Any user browsing the Site ("User") is encouraged to read the Terms and Conditions before completing an order to purchase products on the Site ("Order"); in fact, the submission of an Order implies its acceptance. Any changes to the Agreement will become effective immediately upon posting on the Site and will govern all subsequent Orders.

1. INFORMATION ON EYE

Cruna is a men's clothing brand, specializing in the production of trousers. All products are made entirely by hand and in Italy. On the Site, the User can find information regarding the brand and the purchase of products online.

2. CUSTOMERS

The placing of Orders on the Site is permitted only to natural persons who have the legal capacity to enter into binding agreements in accordance with applicable law and are acting for purposes unrelated to any business or professional activity they may be engaged in ("Customers").

Where requested, Customers must provide their first name, last name, date of birth, email address, delivery address for the Products, social security number and other personal information. Such information must be true, accurate and constantly updated. You may not place Orders on the Site using the name or credentials of another person unless expressly authorized to do so by the person entitled to do so.

The purchase of Products for resale purposes is prohibited.

3. PRODUCT ORDER AND CONCLUSION OF THE CONTRACT

The presentation of products on the Site constitutes an invitation to offer.

The Order can be placed through the Site by selecting any image of the product presented therein and otherwise following the steps and instructions specified on the Site. In order to make any changes and/or corrections to the Order, the Customer must follow the relevant instructions contained on the Site.

The single Order cannot contain more than 5 products at the same time.

The Order will be sent by clicking the "Proceed with Order" button and will be stored in Cruna's order custody database for the period of time provided for by the applicable regulations.

The Order will then be considered a contractual proposal to purchase. Upon receipt of the Order Cruna will send the Customer an email containing the Order number and information about the products ordered, details of the price of each product, the shipping address as well as the payment method. Such email does not constitute acceptance of the Customer's proposed purchase, but only constitutes confirmation of receipt of the Order. Upon receipt of the Customer's Order, Cruna will verify the availability of the products ordered as well as the correctness of the information provided by the Customer.

The sales contract with Cruna will be concluded only with the sending of a separate email of acceptance of the proposed purchase and/or confirmation of shipment of the ordered products.

The Customer's order may be rejected in the event of an error in the information provided by the Customer, in case of a supervening exhaustion of available products, in case insufficient guarantees of solvency are detected, if the order does not correspond to normal consumption needs (a requirement that applies both in relation to the number of products purchased within a single order and in the case of a plurality of orders relating to the same product, even if each order includes a quantity of products corresponding to normal consumption needs), or for reasons of force majeure.

If the order cannot be accepted, Cruna will notify within 10 days after receipt of the order, the possible inability to process the order itself which will be followed by the immediate release of the amount reserved for payment.

4. PRICES

The price of the product published on the Website is per item, expressed in Euros and inclusive of VAT ("Prices"). Cruna will be responsible for the payment of all taxes, duties, charges and/or shipping costs.

Regarding the shipping costs of Orders ("Shipping Charges"), these (where due), inclusive of VAT, will be visible in the Order summary during the checkout process. In general, Shipping Charges to Italy are free of charge for Orders with a value greater than or equal to €150, while for Orders below €150, Shipping Charges amount to €10 per Order. Shipping Charges to Europe are free of charge for Orders with a value greater than or equal to €300, while for Orders with an amount less than €300, Shipping Charges amount to €20 per Order.

Any changes made to the Prices of the products will be effective from the date of publication of the new Prices on the Site, without retroactive effect on Orders already accepted by sending Order Confirmation. Without prejudice to the case of a recognizable error pursuant to Article 1431 of the Italian Civil Code, the Seller reserves the right not to accept an Order due to the incorrectness of the Price published on the Site or indicated in the email sent to confirm receipt of the Order, i.e. prior to its acceptance by the Seller.

5. TERMS OF PAYMENT

Payment by the Customer may be made by credit card, active PayPal account, or other electronic methods. The following credit cards are accepted:

  • Apple Pay

6. DELIVERY

Delivery of the products is made in Italy and Europe (including Bulgaria, Croatia, Denmark, Poland, United Kingdom, Czech Republic, Romania, Sweden, Switzerland and Hungary), to the address indicated by the Customer, only after regular payment of the order submitted to Cruna. In compliance with the provision contained in Article 61 of the Consumer Code, Cruna will make delivery of products no later than 30 days from the day on which the Customer submitted the order.

Under certain circumstances, such as, for example, during periods of sales or business closure, delivery times may vary. The Seller shall not be held liable for delays in delivery that are not attributable to its fault or negligence. Therefore, the Seller shall be exempt from liability for delays due to force majeure, strikes, natural disasters, facts relating to customs clearance procedures, and any other facts relating to the provision of courier services or any other circumstance beyond its control.

The Customer is invited to do everything within its power to facilitate the delivery of the Order, either by making itself available for receipt or by delegating it to a third party.

The courier will make an initial attempt to deliver the Order to the address indicated by the Customer. If the delivery is unsuccessful, the courier will make a further delivery attempt on the following day. In the event that the second attempt is also unsuccessful, the express courier will issue a paper notice containing its contact details and the pick-up point at which it will be possible to collect the products. If the Customer does not pick up the products from the pick-up point within 10 days, the ordered products will be returned to the warehouse. Customer Service will contact the Customer to agree whether to proceed with a new shipment of the ordered products or to make a refund of the relevant payment.

At the time of delivery, the Customer must verify the accuracy of the number of packages and the integrity of the outer packaging. In the event that the Customer finds anomalies in the delivery, for example with reference to the number of packages or in the presence of damage to the outer packaging, the Customer must sign the delivery document with reservation and contact Customer service. In the event that it fails to do so, the Customer may not subsequently raise any objection regarding the delivery, without prejudice to the provisions of Article 9 below regarding hidden defects and in compliance with the legal regulations placed to inderogably protect consumers.

7. RIGHT OF WITHDRAWAL AND RETURNS

Within 14 (fourteen) days from the date of delivery of the Order, the Customer may exercise the right of withdrawal provided for in Article 52 of the Consumer Code, without penalty and without having to provide any reason ("Return Procedure").

In order to activate the Return Procedure, the Customer will be able to: (i) access his profile, (ii) enter the section "Your Orders", (iii) select the product to be returned and (iv) click on "Request Return". Alternatively, the same may contact Customer Service by phone or email requesting to avail of Cruna's Return Procedure.

After multiple withdrawals and returns by a Customer, the Seller may reserve the right to decide whether or not to accept an Order from the same Customer.

During the return request, the Customer must contact the courier to agree on the day and time slots when the collection can be made. Collection of the return must be made no later than 14 days after the exercise of the right of withdrawal.

Following the aforementioned return request, the Customer will receive an email acknowledging that the return has been accepted and indicating the Tracking Number to track and monitor the progress of the shipment.

You may return an item purchased on the Site only if it is in the same condition in which it was received, with every label, security seal, packaging and accessory (case, hanger, garment cover, etc.) received with the Order. Costs for the Return Procedure will be borne by Cruna.

In the event that the exercise of the right of withdrawal satisfies the above conditions, the refund of the value of the returned products, equivalent to their purchase price, will be made by crediting the amount paid by the Customer within 14 (fourteen) calendar days, starting from the date on which Cruna became aware of the request for withdrawal.

Cruna may withhold the refund until it has received the returned goods or until the consumer has demonstrated that it has returned the goods, whichever situation occurs first. Cruna will make such refund using the same means of payment used by the Customer for the initial transaction, unless expressly agreed with the Customer on another means of payment and provided that this does not result in additional charges to the consumer.

To this end, the customer authorizes Cruna to retain his or her bank details and payment information for as long as necessary to exercise the right of withdrawal. Cruna's Return Procedure can only be activated from Italy.

8. CONDITIONS OF INTEGRITY FOR RETURN

According to the provisions of Article 57 of the Consumer Code, the consumer is liable if the products returned by the Customer are damaged, incomplete, deteriorated, and/or used in a manner inconsistent with normal diligence. The Customer must therefore ensure that:

  • the item has not been used or suffered damage during the trial;
  • the item has not been soiled or has undergone washing;
  • the item retains all pendants, labels, the guarantee seal placed on the item at the time of quality control, and the original finish; - the item has not been modified in any way;
  • and in general the item has been used within the limits of normal diligence and not beyond what is necessary to establish its nature, characteristics, and function (e.g., in the case where the item has been worn and not merely tried on).

In particular, all items must be returned inside in the original packaging, with every label, security seal, packaging and accessory (case, hanger, dress cover, etc.) received with the Order, which are considered an integral part of the item.

In case of return of the item damaged, incomplete, deteriorated and/or in conditions of use not in accordance with normal diligence, without prejudice to the right of withdrawal, the Customer will be charged the amount corresponding to the decrease in value of the good. In such cases, Cruna will promptly notify the Customer of the damages and non-conformities found upon receipt of the items. The amount charged to the Customer, which in any case may not exceed the price paid for the purchase of the item, will be deducted from the refund due to the Customer.

9. LEGAL WARRANTY FOR NON-CONFORMING PRODUCTS

the Seller assumes responsibility for any original defects in the Products. The Seller warrants to the Customer that the Products sold are not defective and that they comply with the provisions of the Terms and Conditions, i.e., in particular, that the Products:

  • comply with the description provided on the Site and possess the qualities of the Products that Cruna has presented to the Customer as a sample or model.
  • Are appropriate for the purpose for which goods of the same type are normally used;
  • possess the usual quality and performance of a good of the same type, which the Customer can reasonably expect, taking into account the nature of the good.

For technological reasons, neither Cruna nor the Site can guarantee that the display of colors on the screen will always be accurate. Marginal differences between the description of the Product on the Site and the actual characteristics of the Product will not be considered as a cause of non-conformity of the Product for the purposes of this Agreement.

The conformity warranty of the Products sold on the Site lasts for a period of 2 (two) years from the date of receipt of the Products by the Customer.

The rules set forth in Articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. In the event that a non-compliant Product is delivered, the Customer may request the return of the product within terms of the withdrawal period referred to in Article 7.

10. PRIVACY AND DATA PROTECTION PROVISIONS

The collection and processing of data are carried out for the management and execution of present and future purchase orders and in particular for the performance of obligations arising from these General Terms and Conditions of Sale.

11. APPLICABLE LAW AND PLACE OF JURISDICTION

These general conditions of sale are governed by Italian law.

All disputes relating to these Terms and Conditions of Sale and the contracts regulated by them shall be known by the competent Court of the place of domicile or residence of the Customer according to the applicable law or, at the Customer's choice, by the Court of Vicenza. This is without prejudice to the possibility of promoting the out-of-court settlement of disputes, as provided for in Articles 66 and 141 of the Consumer Code.
