The Terms and Conditions of Sale set out below apply to the purchase of the products (the "Products") displayed on the site shop.cruna.com ("Site") of Cruna Srl ("Cruna" or the "Seller"). Each user browsing the Site ("User") is invited to read the Terms and Conditions before completing a purchase order for products on the Site ("Order"); in fact, sending an Order implies its acceptance. Any modification to the Contract will become effective immediately upon publication on the Site and will govern all subsequent Orders.

Cruna is a menswear brand, specialized in the production of trousers. All products are entirely handmade and in Italy. On the Site, the User can find information about the brand and the purchase of products online.

The conclusion of Orders on the Site is allowed only to natural persons who have the legal capacity to enter into binding agreements in compliance with the applicable law and who act for purposes unrelated to any business or professional activity carried out ("Customers").

Where required, Customers must provide name, surname, date of birth, email address, delivery address of the Products, tax code and other personal information. Such information must be true, accurate and constantly updated. The User cannot place Orders on the Site using the name or credentials of another person, unless expressly authorized by the person entitled.

The purchase of Products for resale is prohibited.

The presentation of the products on the site constitutes an invitation to offer.

The Order can be made through the Site, selecting any image of the product presented therein and in any case following the steps and instructions specified on the site itself. To make any changes and/or corrections to the Order, the Customer must follow the relative instructions contained on the Site.

The single Order cannot contain more than 5 products at the same time.

The Order will be sent by clicking on the "Proceed with the order" button and will be filed in the Cruna order custody database for the period of time established by current legislation.

The Order will therefore be considered a contractual purchase proposal. Upon receipt of the Order, Cruna will send the Customer an email containing the Order number and information about the products ordered, the details of the price of each product, the shipping address and the payment methods. This email does not constitute acceptance of the Customer's purchase proposal, but only constitutes confirmation of having received the Order. Once the Customer's Order has been received, Cruna will check the availability of the ordered products as well as the correctness of the information provided by the Customer.

The sales contract with Cruna will only be concluded with the sending of a separate email accepting the purchase offer and/or confirming the shipment of the products ordered.

The Customer's order may be refused in the event of an error in the information provided by the customer, in the event of exhaustion of the available products, in the event of insufficient guarantees of solvency, if the order does not correspond to normal consumption needs (requirement which applies both in relation to the number of products purchased within a single order and in the case of multiple orders relating to the same product, even if each order includes a quantity of products corresponding to normal consumption needs) or due to force majeure.

If the order cannot be accepted, Cruna will communicate within 10 days. subsequent to the receipt of the order, the possible impossibility of fulfilling the order itself which will be followed by the immediate release of the amount reserved for payment.

The price of the product published on the site refers to a single item, expressed in Euros and inclusive of VAT ("Prices"). Cruna will pay all taxes, duties, charges and/or shipping costs.

As regards the shipping costs of the Orders ("Shipping Costs"), these (where due), inclusive of VAT, will be visible in the Order summary during the checkout procedure. In general, the Shipping Costs to Italy are free for Orders with a value greater than or equal to €150, while for orders of less than €150, the Shipping Costs amount to €10 per Order. Shipping costs to Europe are free for Orders with a value greater than or equal to €300, while for orders of less than €300, the Shipping costs amount to €20 per Order.

Any changes to the Product Prices will take effect from the date of publication of the new Prices on the Website, with no retroactive effect on Orders already accepted with the sending of the Order Confirmation. Without prejudice to the case of a recognizable error pursuant to art. 1431 of the Civil Code, the Seller reserves the right not to accept an Order due to the erroneous Price published on the Site or indicated in the email sent to confirm receipt of the Order, i.e. before acceptance of the same by the Salesperson.

Payment by the Customer can be made by credit card, active PayPal account or other electronic methods. The following credit cards are accepted:

- Visa/Visa Electron;
- Mastercards;
- American Express;
- Maestro International;
- PayPal;
-Google Pay;
- Apple Pay.

The delivery of the products is carried out in Italy and in Europe (including Bulgaria, Croatia, Denmark, Poland, United Kingdom, Czech Republic, Romania, Sweden, Switzerland and Hungary), to the address indicated by the Customer, only after the regular payment has been made of the order forwarded to Cruna. In compliance with the provision contained in art. 61 of the Consumer Code, Cruna will deliver the products no later than 30 days from the day on which the Customer sent the order.

In certain circumstances, such as, for example, during sales periods or company closures, delivery times may vary. The Seller cannot be held responsible for delays in delivery not attributable to its fault or negligence. Therefore, the Seller will be exempt from liability for delays due to force majeure, strikes, natural disasters, facts relating to customs clearance procedures, and any other fact relating to the provision of courier services or any other circumstances beyond its control.

The Customer is invited to do everything in his power to facilitate the delivery of the Order, making himself available for reception or delegating it to third parties.

The courier will make a first attempt to deliver the Order to the address indicated by the Customer. If delivery is unsuccessful, the courier will make a further delivery attempt the next day. In the event that the second attempt is also unsuccessful, the express courier will issue a paper notice containing their contact details and the collection point where it will be possible to collect the products. If the Customer does not collect the products from the collection point within 10 days, the ordered products will be returned to the warehouse. The Customer Service will contact the Customer to agree whether to proceed with a new shipment of the ordered products or whether to refund the relative payment.

At the time of delivery, the Customer must verify the accuracy of the number of packages and the integrity of the external packaging. In the event that the Customer finds anomalies in the delivery, for example with reference to the number of packages or in the presence of damage to the external packaging, the Customer must sign the delivery document with reserve and contact Customer service. In the event that he fails to do so, the Customer will not subsequently be able to make any objection regarding the delivery, without prejudice to the provisions of the following art. 9 on the subject of hidden defects and in compliance with the law for the mandatory protection of consumers.

The Customer can contact the Customer Service by filling out the form on the Site or at the email address online@cruna.com.

Within 14 (fourteen) days from the date of delivery of the Order, the Customer can exercise the right of withdrawal provided for in article 52 of the Consumer Code, without any penalty and without having to provide any reason ("Return Procedure").

In order to activate the Return Procedure, the Customer can: (i) access their profile, (ii) enter the "Your orders" section, (iii) select the product to be returned and (iv) click on "Request made". Alternatively, the same can contact Customer Service by phone or email asking to make use of the Cruna Return Procedure.

After multiple withdrawals and returns by a Customer, the Seller may reserve the right to decide whether or not to accept an Order from the same Customer.

During the return request, the Customer must contact the courier to agree on the day and time slots in which the collection can be made. The withdrawal of the return must take place no later than 14 days from the exercise of the right of withdrawal.

Following the aforementioned return request, the Customer will receive an email confirming the return has been taken over and an indication of the Tracking Number to track and check the progress of the shipment.

It is possible to return an item purchased on the Site only if it is in the same condition in which it was received, with every label, security seal, packaging and accessory (case, coat hanger, coat cover, etc.) received with the Order. The costs for the Return Procedure will be borne by Cruna.

In the event that the exercise of the right of withdrawal meets the above conditions, the refund of the value of the returned products, equivalent to their purchase price, will take place by crediting the amount paid by the Customer within 14 (fourteen) calendar days, starting from the date on which Cruna became aware of the request for withdrawal.

Cruna may withhold the refund until it has received the goods subject to withdrawal or until the consumer has demonstrated that he has returned the goods, depending on which situation occurs first. Cruna will make this refund using the same means of payment used by the Customer for the initial transaction, unless expressly agreed with the Customer on another means of payment and on condition that this does not lead to additional costs for the consumer.

To this end, the customer authorizes Cruna to keep his bank details and payment data for the time necessary to exercise the right of withdrawal. The Cruna Return Procedure can only be activated from Italy.

According to the provisions of article 57 of the Consumer Code, the consumer is responsible if the products returned by the Customer are damaged, incomplete, deteriorated and/or used in a way that does not comply with normal diligence. The Client must therefore ensure that:
- the item has not been used or has suffered damage during the trial;
- the item has not been soiled or washed;
- the article retains all the pendants, the labels, the guarantee seal placed on the garment at the time of the quality control and the original finishes; - the article has not undergone modifications of any kind;
- and in general the item has been used within the limits of normal diligence and not beyond what is necessary to establish its nature, characteristics and functioning (e.g. if the item has been worn and not just tried on).

In particular, all items must be returned in their original packaging, with every label, security seal, packaging and accessory (case, coat hanger, coat cover, etc.) received with the Order, considered an integral part of the item.

In case of return of the damaged, incomplete, deteriorated and/or in conditions of use that do not comply with normal diligence, without prejudice to the right of withdrawal, the Customer will be charged the sum corresponding to the decrease in value of the goods. In such cases, Cruna will promptly notify the Customer of the damages and non-conformities found upon receipt of the items. The sum charged to the Customer, which in any case cannot be higher than the price paid for the purchase of the item, will be deducted from the refund due to the Customer.

For any doubts, the Customer can contact Customer Service.

the Seller assumes responsibility for any original defect of the Products. The Seller guarantees to the Customer that the Products sold are not defective and that they comply with the provisions of the Terms and Conditions, that is, in particular, that the products:
- comply with the description provided on the Site and possess the qualities of the Products that Cruna has presented to the Customer as a sample or model;
- are appropriate for the purpose for which goods of the same type are normally used;
- possess the usual quality and performance of an asset of the same type, which the Customer can reasonably expect, taking into account the nature of the asset.

For technological reasons, neither Cruna nor the Site can guarantee that the display of colors on the screen will always be accurate. Marginal differences between the description of the Product on the Site and the actual characteristics of the Product will not be considered as a cause of non-conformity of the Product for the purposes of this Contract.

The guarantee of conformity of the Products sold on the Site lasts for a period of 2 (two) years from the date of receipt of the Products by the Customer.

The rules referred to in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. In the event that a non-compliant Product is delivered, the Customer may request the return of the product within the terms of the withdrawal period referred to in art. 7.

The collection and processing of data are carried out for the management and execution of present and future purchase orders and in particular for the execution of the obligations deriving from these General Conditions of Sale.

These general conditions of sale are governed by Italian law.

All disputes relating to these Terms and Conditions of Sale and to the contracts regulated by them will be known by the competent Court of the place of domicile or residence of the Customer on the basis of the applicable law or, at the choice of the same, by the Court of Vicenza. Without prejudice to the possibility of promoting the out-of-court settlement of disputes, as provided for by articles 66 and 141 Consumer Code.
