This sweepstakes program is operated by CRUNA srl with registered office in Vicenza, via Vecchia Ferriera 141, VAT IT03621630247, C.F. and Register of Companies of Vicenza 03621630247 as the promoting entity ("CRUNA" or "Promoter").
These terms and conditions, together with CRUNA's privacy policy ("Privacy Policy"), which together will be referred to as the "Program Terms and Conditions," apply to participation in the Cruna Club Program (as defined below). This Cruna Club Sweepstakes Program (the "Program") is open to all consumers who are 18 years of age or older. It should be noted that only purchases of CRUNA products made on the website www.cruna.com directly managed by Cruna srl will be covered by the Program (therefore, any purchases of CRUNA products made, merely by way of example, at vending machines, online market places, corners within Department Stores, franchisees, etc., will remain excluded from the scope of the Program).
This Cruna Club Rewards Program (the "Program") is open to all consumers who are 18 years of age or older. It should be noted that only purchases of CRUNA products made on the website www.cruna.com directly managed by Cruna srl will be covered by the Program (therefore, any purchases of CRUNA products made, purely by way of example, at vending machines, online market places, corners within Department Stores, franchisees, etc., will remain excluded from the scope of the Program).
1. You do not need to make purchases to create a Cruna Club account (the "account") and become a member ("Member" or "Members"), while you will need to make purchases to accumulate points and access Program Levels (see Step 6 for details). Internet access and a valid e-mail address are required.
2. Duration of the Program: the Program will start on 15.02.2025 and remain available until 31.12.2026, cruna reserves the right to change the duration of the Program.
3. To register for the Program as a new Member: from the start date of the Program, consumers must log on to www.cruna.com and register by providing their mandatory data (first and last name, email address and date of birth) and, if applicable, optional phone number data by accepting the Program Terms and Conditions to create an account and become a Member. When registering/creating an account, privacy consents - as outlined in the Promoter's Privacy Policy - e.g. marketing and profiling will also be requested, which are not binding for the purposes of Program membership but, if provided, allow you to fully enjoy the Program.
4. Consumers may only register for the Program once. If it is determined that a consumer has registered for the Program more than once, CRUNA Ltd. reserves the right to suspend or terminate their account.
5. To accumulate points: from the start date of the Program, Members can accumulate points according to the following instructions: Members must log in to their account before finalizing the transaction on the www.cruna.com site. For every euro spent on the Cruna site, 1 point will be loaded to the Program Member's account (1€=1 Cruna Club point).
6. Points cannot be charged for previously issued receipts or previously made online purchases. It is also not possible to charge points at a time after purchase for transactions made without the Member having identified himself/herself in the prescribed manner.
7. Exceptions:
- No points will be calculated or credited for purchases or transactions with a value less than €1.00 (one/00). Points will be calculated based on the total price of products and services, and points will be credited based on rounding down to the nearest whole number.
- No points will be calculated or credited for the purchase of a Gift Card, while points will be credited for using the Gift Card for a purchase.
- Some items may be excluded from the Program at CRUNA's discretion and, therefore, their purchase will not accrue any points to the Participant.
8. Levels of participation in the Program (the "Levels"):
- CRUNA MEMBER: New members and Members who have collected from 0 points to 799 points access this level
- SILVER CRUNA: New members and Members who have collected 800 points to 1999 points access this level
- CRUNA GOLD: New members and Members who have collected from 2000 points to 2999 points access this level
- CRUNA PLATINUM: New members and Members who have collected 3000 points to 3999 points access this level
- CRUNA FAN: New members and Members who have collected from 4000 points to 4999 points collected access this level
- CRUNA LOVER: New members and Members who have collected 5000 points to 5000+ points collected access this level
9. Additional details and conditions of the Program Levels: a) Upon enrollment in the Program, all new Members will be automatically assigned to the CRUNA MEMBER level, Members will access the next Level corresponding to the total value of purchases made since the beginning of the program, after deducting the value of any returns. c) The benefits offered by the MEMBER, SILVER, GOLD and PLATINUM levels may be used in combination with other offers, to be verified from time to time against the directions specified by the Promoter. d) Members enrolled in Cruna Club will be able to take advantage of the benefits shown in the following table:
e) Members may use only one benefit per purchase. f) *Unlimited use referred to benefits provided upon reaching Cruna Platinum, Cruna Fan and Cruna Lover levels is to be considered at all times within the duration of the Cruna Club program indicated in item 2. g) The above prizes/gifts may be subject to change.
10. Timing of points crediting: awarded Cruna Club points will be credited to Members' accounts within 48 hours of purchase, barring technical glitches that may delay crediting. To report any delays in crediting, you may contact us at. [email protected]
11. Checking point balance: Members can check their accumulated point balance by logging into their online account.
12. Points cancellation: in the event of full or partial return of products or services purchased on the online shop, with respect to which points have been awarded (for example, in the event that the Member exercises the right of withdrawal or terminates the purchase contract, or otherwise returns the item purchased for which the points were credited), CRUNA will cancel the points awarded in proportion to the amount refunded and by reason of the points acquired at the time of the transaction.
13. Account Termination: - a. Members may terminate their account and end their membership in the Program at any time simply by submitting a request to Cruna Customer Service, consulting the FAQ section, or by emailing us at. [email protected]. - b Once you cancel your membership in the Program, you will no longer be able to use the Privileges associated with your accumulated points or redeem them in any way. - c. CRUNA may exclude a Member from the Program by revoking the Member's membership with immediate effect for good cause by giving written notice to the Member containing a statement of the reasons therefor. Just cause includes, but is not limited to, fraudulent or improper use of the Program or other violations of the Program Terms and Conditions or applicable laws. Revocation will no longer allow the accumulation of points on purchases made and will result in the loss of benefits provided by the membership level. All previously accumulated points will be lost and cannot be used by or transferred to other Members.
14. Personal use: only Members who make purchases for personal use will be able to accumulate points. Therefore, VAT-registered Members who make purchases for business or professional activities are excluded.
15. Modifications: CRUNA reserves the right to supplement or modify the Terms and Conditions of the Program taking care that the modifications made do not affect the rights acquired by Members. Any changes will be made known to Members through appropriate notices at www.cruna.com.
16. Suspension or Early Termination of the Program: CRUNA may suspend or terminate the Program in accordance with the timelines set forth in Section 3. Early termination and suspension (with their respective consequences) will be communicated to Members at least 30 days in advance or, with respect to suspension, as far in advance as possible or, at the latest, immediately after suspension. Such notice may be given by CRUNA via the website or through other communications regarding the Program.
17. Inquiries related to the Program: For any questions or complaints regarding the Program, Members may contact CRUNA Customer Service at. [email protected] or consult the FAQ
18. CRUNA is committed to running a fair and safe program and preventing abuse. If participation is not in accordance with these Terms and Conditions, the account will be terminated. Any benefits or points awarded may be cancelled and may be required to be returned, and the Promoter reserves the right to prohibit participation in the Program for a minimum period of six months. For this reason, the Promoter reserves the right, at any time, to: - a. exclude Members who alter the Program or otherwise fail to comply with the requirements of these Terms and Conditions; - b. cancel, modify, or suspend the Program if it could not run as planned for reasons including, but not limited to, tampering, unauthorized intervention, fraud, bad faith, technical failures, or any other cause beyond the control of the Promoter that compromises or affects the administration, security, fairness, integrity, or proper conduct of the Program.
19. Benefits and points awarded by the Program are not transferable or exchangeable and cannot be redeemed for cash or other form of compensation. If for any reason a benefit is unavailable, the Promoter reserves the right, at its sole discretion, to replace such benefit or an element thereof with another of equal or greater value.
20. The Promoter and its associated agencies and companies shall not be liable for any losses (including, without limitation, indirect, special or consequential losses or loss of profits), expenses or damages suffered or incurred (whether or not resulting from the negligence of any person) in connection with this Program or the acceptance or use of benefits, except for those liabilities that cannot be excluded by law. Nothing shall exclude the Promoter's liability for death or personal injury due to its negligence.
21. The Promoter shall not be responsible for any delay or failure to perform for reasons beyond its reasonable control resulting from, but not limited to, acts of God, global or local epidemics or pandemics, adverse weather conditions, fire, labor disputes, war, terrorist activities, computer network problems and/or cyber attacks, hostilities, political unrest, riots, civil commotion, pestilence or other natural disasters, or any other circumstances.
22. All personal data provided for an account will be used for the purposes of this Program and for research and analysis purposes by Promoter and/or agents engaged by Promoter to assist in the administration of the Program. Personal data will not be disclosed to extraneous third parties unless affirmative consent has been obtained. Personal data will be processed in accordance with thePromoter's Privacy Policy.
23. If one or more portions of these Terms and Conditions are found to be legally invalid, illegal, or unenforceable, the remaining portions will not be affected and will remain in full force and effect.
24. By creating an account, you will be deemed to have agreed to be bound by these Terms and Conditions.
25. Participation in the Transaction shall be governed in the manner specified in these Rules, the self-certified original of which shall remain deposited and kept at the headquarters of CRUNA SRL for the entire duration of the Transaction and for 12 months following its conclusion.
26. CRUNA reserves the right to make changes to the Rules, without prejudice to Participants' vested rights, and to withdraw the Program at any time for good cause and after appropriate publicity of the withdrawal. Any changes will be effective as of the date indicated in the relevant notices sent by e-mail to Participants or posted on cruna.com. A constantly updated version of the Rules will be available on the cruna.com website. Therefore, each Participant is invited to periodically consult these Rules in order to be kept informed of any updates and/or changes to them.
27. This Transaction (and its possible revocation) will be publicized on the website www.cruna.com
28. By registering for the Cruna Club Program, you agree and undertake to abide by the terms and conditions of use of the Program and give your consent for CRUNA to collect and use the personal data voluntarily provided by you and the data collected from your activities within Cruna Club and www.cruna.com, guaranteeing the strictest confidentiality in the processing of Participants' personal data, in accordance with the applicable data protection legislation.
FINAL NOTES.
29. Participation in Operation Cruna Club is free of charge.
30. Participation implies full acceptance of the provisions of these Rules and Regulations.
31. It is the Participant's responsibility to ensure that contact and participation information is correct and active; otherwise, participation cannot be guaranteed.
32. CRUNA SRL assumes no responsibility for events beyond its control, such as but not limited to: access, impediment, malfunction or difficulty regarding technical tools, computer, cables, electronics, software and hardware, transmission and connection that may prevent Participants from participating in this Transaction.
33. CRUNA SRL reserves the right to carry out all verifications regarding the correct participation in the initiative. In the event that the Participants are found to have used fraudulent means and instruments or in violation of the provisions of these Regulations, they will be excluded from the initiative and will lose any rights they may have claimed. In this case, the Promoter reserves the right to proceed, in the terms deemed most appropriate and in compliance with applicable laws, to limit and inhibit any initiative aimed at circumventing the system devised and the mechanics of the initiative.
34. Communications or Complaints: for any communication, information or complaint regarding an Order and these General Terms and Conditions of Sale, the Customer may contact Customer Service on the Contact Us page or by email to: [email protected].
35. All disputes relating to these Terms and Conditions of the Program shall be known by the competent Court of the place of domicile or residence of the Customer according to the applicable law or, at the Customer's choice, by the Court of Vicenza. This is without prejudice to the possibility of promoting the out-of-court settlement of disputes, as provided for in Articles 66 and 141 of the Consumer Code.
